RENTAL LIABILITY WAIVER & RELEASE AGREEMENT

Company Name: Boyd Trailer Rentals, LLC
(Hereinafter referred to as the “Company”), including its owners, officers, employees, agents, and affiliates.

Jurisdiction: Florida

1. Damage, Loss & Financial Responsibility

I, the renter, accept full responsibility for:

- Any damage to the equipment or the operation of equipment/components.
- Tire replacement if damaged, including wheel if heavily damaged.
- Loss or theft of accessories or safety gear.
- Excessive cleaning or misuse.
- Any damage caused to third party property during rental period.
- Any tolls or fees incurred during rental period.

I authorize the Company to charge the payment method on file for repair, replacement, or related costs.

2. Assumption of Responsibility

I, the renter, certify that:

- I am physically and mentally capable of operating or using the equipment.
- I will comply with all safety instructions, posted rules, and Company guidelines.
- I will always operate the equipment in a safe and responsible manner.
- I will not operate the equipment while impaired by alcohol, drugs, or medication.

3. Release of Liability

To the fullest extent permitted by applicable law, I hereby release, waive, discharge, and agree not to bring any claim against the Company for any injury, death, loss, or damage arising out of or related to use or operation of rented equipment, participation in rental activities.

This release applies whether such claims arise from negligence or otherwise, except where prohibited by law.

4. TOLLS, FINES, AND ADMINISTRATIVE FEES

Renter Responsibility:
- The Renter agrees to pay all tolls, parking tickets, traffic violations, and towing fees incurred during the rental period.
Authorization to Charge Card:
- The Renter expressly authorizes the Owner to charge the credit card on file for the actual cost of any tolls or violations incurred, plus an Administrative Processing Fee of $25.00 per individual toll invoice or violation notice received by the Owner.
Delayed Billing:
- The Renter acknowledges that Florida TOLL-BY-PLATE invoices and citations can take up to sixty (60) days to be processed by the state. The Owner reserves the right to charge the credit card on file at any point within this 60-day window upon receipt of the official notice.
SunPass Usage:
- If the Renter uses a personal SunPass transponder, they must ensure the rented trailer's license plate is accurately added to their SunPass account prior to entering any toll roads. The Renter remains liable for any tolls that fail to attach to their personal account.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Company from all claims, demands, damages, losses, costs, or expenses (including legal fees) arising from my operation or use of any rented equipment, violation of this agreement, injury or damage caused to third parties by me or members of my group.

6. Acknowledgment of Risk

I, the Renter, understand that using the rented items, tools, or electronics, may involve inherent risks, including but not limited to: shock, burns, damage to personal property, mechanical failure, hidden defects in equipment, lacerations or impact injuries.

These risks may result in serious injury, permanent disability, or death. I knowingly and voluntarily assume all risks associated with equipment rental and use.

7. Severability

If any portion of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.

8. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or representations, written or oral.

9. Acknowledgment

I have read this Agreement carefully, fully understand its contents, and sign it voluntarily. I understand that by signing this Agreement, I am giving up certain legal rights.
